Upton headed to Braves; Pettitte returns to Yanks

B.J. Upton is on his way to Atlanta, while Andy Pettitte is staying in pinstripes.

With the winter meetings only days away, baseball's offseason began to heat up Wednesday with a pair of moves involving potential closers: Ryan Madson joined the Angels and Jonathan Broxton remained with the Reds.

Hours later, the Braves made big news.

Looking for a new center fielder and some right-handed pop, Atlanta found both in Upton, who had 28 homers and 31 steals for Tampa Bay last season. The fleet-footed free agent agreed to a $75.25 million, five-year contract, a person familiar with the deal said Wednesday night.

The person spoke to The Associated Press on condition of anonymity because the deal had not been completed. It was expected to be announced Thursday once Upton passes his physical.

Upton's score would be the biggest free-agent contract of the offseason so far and the largest in Braves history.

Pettitte, meanwhile, will return for another season with the New York Yankees.

Feeling strong at age 40, the veteran lefty completed a one-year deal worth $12 million, putting baseball's biggest postseason winner back in the Bronx.

"I think we're good enough to go all the way, I really do," Pettitte said on a conference call. "I'm at the point where, if I didn't feel like we had a chance to win it deep down, I wouldn't do this."

The five-time World Series champion retired after the 2010 season to spend more time at home but then decided to come back this year ? while working as an instructor during spring training ? and signed a contract guaranteeing him $2.5 million.

Pettitte went 5-4 with a 2.87 ERA in 12 starts. He missed almost three months because of a broken lower left leg, sustained when he was hit by a line drive off the bat of Cleveland's Casey Kotchman on June 27.

"I definitely think that if I would have pitched a full season and thrown 200 innings, that I definitely wouldn't feel as fresh and physically feel as good as I do right now," Pettitte said. "Obviously, I feel like that helped lead me to a quick decision."

The move means the AL East champs are set to start 2013 with the same rotation as last season: CC Sabathia, Hiroki Kuroda, Pettitte, Phil Hughes and Ivan Nova or David Phelps.

Next up for general manager Brian Cashman could be a contract for 43-year-old closer Mariano Rivera, determined to come back from a torn knee ligament.

Madson is making a comeback from Tommy John surgery, and he agreed to a one-year deal with the Los Angeles Angels five days before the start of baseball's winter meetings in Nashville, Tenn.

The longtime Philadelphia reliever missed last season with Cincinnati, which signed him in January after a stellar performance in 2011 with the Phillies. He had surgery in April on a torn ligament in his right elbow.

Well ahead of schedule in his recovery, Madson said he expects to be the Angels' closer. General manager Jerry Dipoto agreed the veteran is likely to supplant Ernesto Frieri when fully healthy.

"I feel like if I can throw the ball like I'm capable of, I expect to have that role," Madson said. "I expect to come to spring training and earn the job."

Broxton isn't sure what role he'll have in Cincinnati after securing a $21 million, three-year contract that gives the NL Central champions a chance to reconfigure their starting rotation.

The two-time All-Star came to the Reds last July in a trade with Kansas City. He filled in as the closer when Aroldis Chapman developed a tired shoulder and had four saves in six chances overall with a 2.82 ERA.

Now the Reds have the option of turning Chapman into a starter, which was the plan last season until Madson blew out his elbow. The team has told Chapman to prepare for next season as a starter, although it hasn't committed to Broxton as the closer.

"Nothing's in stone right now," assistant general manager Bob Miller said. "When we talked to Jonathan we said he was going to be at the back end of the bullpen. What happens depends on spring training and how things play out in the offseason."

Broxton wanted a multiyear deal so he could settle in one place. He didn't insist on assurances he'd be a closer.

"I went into the offseason with an open mind," Broxton said. "I've got experience in both roles. Even if Chapman doesn't work out as a starter, he can come back in and fill in as the closer. I'll be happy to throw the eighth (inning). It doesn't matter. You saw what he did last year."

The 28-year-old Upton hit .246 with 78 RBIs for the Rays last season. He will replace free agent Michael Bourn as the Braves' center fielder and should provide much-needed power from the right side.

Upton's first full season with Tampa Bay was 2007, when he hit a career-best .300 with 24 homers and 22 stolen bases. His home run totals have increased in each of the last three seasons, but he has hit below .250 with more than 150 strikeouts in four straight years.

Bourn was the Braves' leadoff hitter, but Upton is not expected to fill that role.

Elsewhere, the Boston Red Sox made a flurry of minor moves, trading right-handers Zach Stewart and Sandy Rosario as well as third baseman Danny Valencia.

Stewart was sent to Pittsburgh and Rosario to Oakland for players to be named. Valencia was shipped to Baltimore for cash.

Boston also hired Greg Colbrunn as hitting coach.

Athletics reliever Pat Neshek agreed to a one-year contract that avoided salary arbitration, while Kansas City traded right-hander Vin Mazzaro and first baseman Clint Robinson to the Pirates for minor league pitchers Luis Santos and Luis Rico.

The Chicago Cubs designated right-hander Casey Coleman for assignment to make roster room for newcomer Scott Feldman, who agreed to a $6 million, one-year contract the previous day.

Feldman's former team, the Texas Rangers, acquired right-hander Cory Burns from San Diego for a player to be named or cash.

Texas millionaire charged with child molestation

LUBBOCK, Texas (AP) ? An arrest warrant was issued Wednesday for Amarillo millionaire and eccentric artist Stanley Marsh 3, who is being charged with 11 felony counts of child molestation.

Special prosecutor Matt Powell said Marsh faces six counts of child sexual assault and five counts of sexual performance by a child that involve two alleged victims. He said he did not know whether Marsh had been taken into custody.

"This is the beginning of the process," Powell said. "This is what we felt like we needed to do."

He said the charges against Marsh could go before a grand jury in the next few weeks or soon after the first of the year.

Several lawsuits filed in the past few months claimed that Marsh paid at several teenage boys ranging in age from 15 to 16 for sexual acts. The teens weren't named in the suits. One said Marsh gave him drugs and alcohol.

Marsh is probably best known for planting 10 brightly painted Cadillacs nose down along a Panhandle highway in the 1970s.

His attorney, Kelly Utsinger, did not immediately return a call seeking comment.

Marsh, 74, is an Amarillo native and philanthropist who along with his wife has donated to local art and education causes. After he suffered a series of strokes, his wife was appointed his guardian.

Marsh was indicted on charges of indecency with a child in 1996, but the charges were eventually dismissed. That same year Marsh acknowledged no wrongdoing in a settlement with a youth who claimed Marsh sexually abused him.

For agonizingly slow speakers, prod them gently with monosyllabic sounds (?hmmm?) to signal you?re listening. Take notes to remind yourself what you want to say next. And wait an extra second or two after you think they?re done speaking, rather than jump in too soon.

Former SD Gov. Rounds announces run for US Senate

PIERRE, S.D. (AP) ? Former South Dakota Gov. Mike Rounds said Thursday that he will run for the U.S. Senate in 2014, setting the stage for what will likely be a high profile race between the Republican and the Democratic incumbent, Sen. Tim Johnson.

Rounds, 58, said he has worked well with Johnson in the past and considers him a friend. But he said he and Johnson disagree on some key issues.

"At this stage of the game, it's a matter of the direction of this country," Rounds said.

Johnson, 65, released a statement Thursday saying he intends to "put together a winning campaign in the weeks and months ahead," and that he will formally announce next year whether he'll seek a fourth term.

At a news conference announcing his candidacy, Rounds said he is running because he wants to end gridlock in Washington and help reduce the federal deficit, straighten out health care reform, set good farm policies and protect industry from undue regulation.

Rounds said he learned during his two terms as governor that an elected official can stick to principles, such as controlling government spending, and still get things done.

"We need to become a country of cooperation instead of confrontation," he told a crowd of about 100 who showed up for his announcement.

Rounds was a state senator from 1991 to 2001 before serving two terms as governor from 2003 to 2011. After leaving office in early 2011, Rounds returned to his job as president and CEO of an insurance and real estate company based in Pierre.

Johnson was elected to the U.S. House in 1986 and to the Senate in 1996. He was re-elected in 2002 and 2008. He also previously served in the state Legislature.

The state Democratic Party immediately mounted a defense after the morning announcement. Party Chairman Ben Nesselhuf called Rounds a "nice guy with the wrong priorities" for South Dakota.

Johnson was more complimentary.

"I had an excellent working relationship with (Rounds) during his eight years as Governor, and the fact that he has already re-stated his refusal to take the Grover Norquist 'no tax increases under any circumstances' pledge is a very good sign," Johnson said in a statement.

But he added that he still feels great and has work to do.

"In the meantime, I intend to continue to focus on my important work representing South Dakota," he said.

Johnson defeated prostate cancer in 2004 and had surgery in December 2006 to stop bleeding in his brain. He was diagnosed with arteriovenous malformation, a condition that causes arteries and veins in the brain to grow abnormally large, become tangled and sometimes burst.

Bob Burns, a retired South Dakota State University political science professor, said Rounds will be a formidable candidate and Johnson represents the Democrats' best chance of keeping the seat.

Rounds became known as "Mr. Nice Guy," after he won the 2002 Republican gubernatorial primary against two other candidates who engaged in a nasty battle of attacks, and Rounds was able to maintain that image through his years as governor, Burns said.

"He left the office of governor without receiving a lot of sharp criticism, but at the same time not garnering an undue enthusiasm either," Burns said.

Rounds said he doesn't expect the campaign to begin in earnest until early 2014, but he had to declare his candidacy now to begin building the campaign organization and raising the money needed to challenge an incumbent.

His campaign said his accomplishments as governor included beginning construction of an underground science laboratory at the former Homestake gold mine in the Black Hills, boosting tourism, increasing research at state universities, creating college scholarships, working with the congressional delegation to save Ellsworth Air Force Base from closure in 2005, and helping to make South Dakota a business-friendly state with low taxes.

Rounds said he meant it when he said several years ago he did not want to run for the Senate, but he is running now to make sure his five grandchildren and other young Americans are not saddled with a huge federal debt and have a chance to get an education and good jobs.

"If you can make a difference, you should step forward. That's the reason I'm running. I think I can make a difference," Rounds said.

Scientists build structures with tiny bricks of DNA

A video from Harvard's Wyss Institute explains how strands of DNA can be assembled into three-dimensional nanostructures like tiny Lego building blocks.

Researchers at Harvard's Wyss Institute have coaxed single strands of DNA to fit together like Lego bricks and form scores of complex three-dimensional shapes, including a teeny-tiny space shuttle. The technique, described in this week's issue of the journal Science, adds a new dimension to molecular construction and should help open the way for nanoscale medical and electronic devices.

"This is a simple, versatile and robust method," the study's senior author, Peng Yin, said in a news release.


The method starts with synthetic strands of DNA that take in just 32 nucleotides, or molecular?bits of genetic code. These individual "bricks" are coded in a way that they fit together like Lego pegs and holes to form larger shapes of a specific design. A cube built up from 1,000 such bricks (10 by 10 by 10) measures just 25 nanometers in width. That's thousands of times smaller than the diameter of a single human hair.

The latest research builds upon work that the Wyss researchers detailed in May, which involved piecing together DNA strands to create two-dimensional tiles (including cute smiley faces). This time around, the strands were twisted in such a way that they could be interlocked, Lego-style. As any visitor to Legoland knows, such structures can get incredibly complex in the hands of a skilled builder.

Yin and his colleagues are still learning their building techniques. Fortunately, the bricks could be programmed to build themselves, with the aid of 3-D modeling software. Once the designs were set, the researchers synthesized strands with the right combinations of nucleotides ??adenosine, thymine, cytosine and guanine ? so that when they were mixed together in a solution, at least some of the bricks would form the desired design.

To demonstrate the method, 102 different 3-D shapes were created using a 1,000-brick template.

The Wyss researchers reported a wide variation in assembly success rate, or yield: Depending on the design, the yield ranged from 1 percent to 40 percent.?That's roughly in the same range as the success rate for another method for molecular assembly, known as DNA origami. The origami method requires more custom work to design the "staples" to hold the DNA structures together, while the Lego-style method can rely more easily on a standard toolbox of DNA bricks.

In the future, DNA origami and DNA brick-building may be used together, said Kurt Gothelf, director of the Center for DNA Nanotechnology at Aarhus University in Denmark. "It is likely that a combination of the two methods will pave the way for making even larger structures in higher yields," Gothelf wrote in a commentary for Science.

Researchers say complex nanostructures could be used as smart drug delivery devices inside the human body, or as the components for microscopic electronic or photonic devices. It may look as if scientists are just playing around with smiley faces and toy shuttles, but a few years from now, DNA bricks will be no laughing matter.

[Each voxel represents an 8-base-pair connection between bricks.] Second, a list of a master collection of DNA strands (we ordered 4,455 strands) was generated based on the 3-D canvas. This master collection of strands covers all possibilities of shapes that can be designed from the 1,000-voxel 3-D canvas. Then we made 102 shapes using the software; each shape was designed by removing the unwanted voxels. At last, the software translates each shape to a recipe list of strands and sends the information to a robot for mixing the ingredients."

Q: I mentioned a couple of figures in the May report on your team's work with 2-D shapes: 12 to 17 percent yield, expected production of one desired shape per hour, $7,000 to synthesize a toolkit theoretically capable of producing 2 x 10^93 shapes. Do you have comparable figures for 3-D brick production?

A: "Yields of 3-D DNA-brick shapes were, on average, lower than 2-D DNA-brick shapes, but comparable to 3-D DNA origami structures. We saw yields varied from 1 percent to 40 percent, depending on the designs. The robot can make one 3-D shape per hour, which is similar to the pace for making 2-D shapes.? The master collection of 4,455 strands cost about $11,000, but we can produce 2^1000 (about 10^301) potential shapes. The much larger number of potential shapes is due to the higher resolution in our 3-D brick design." [The size of the voxels is smaller, with just 8 base pairs per voxel.]

A:?"Combining multiple DNA-brick structures to form a larger structure via 'hierarchical assembly' is certainly on our mind. I think we will inevitably need to combine many different DNA assembly methods, including DNA brick and DNA origami."

Q: It sounds as if you expect bricks as well as origami to be used together for nanostructure synthesis. Is this a change from the way you expected the field to develop in earlier days, or did you always expect that the two approaches would end up being used in combination?

A: "The ultimate goal of the DNA-brick technique and DNA origami is the same: making larger, more complex, more stable DNA structures. The two methods are also intrinsically connected.

"I borrow a paragraph from our paper: 'DNA origami can also be related to the brick framework, in which half of the bricks are concatenated into a long scaffold. ... The successes of constructions that use only short strands (as in bricks) and those that include a long scaffold (as in origami) together suggest a full spectrum of motif possibilities with strands of diverse lengths: Longer strands may provide better structural support, and shorter ones may provide finer modularity and features; the eclectic use of both may lead to the most rapid progression toward greater complexity.'

"We certainly expect the two techniques will complement each other."

Q: Do you feel as if this establishes a sufficient toolkit for nanostructure building, or are there other steps or techniques that will still be required? Are you working on additional techniques?

??A:?"Far from sufficient. The DNA-brick technique is great, compared with a lot of existing methods. It is modular, simple, and can make many complex shapes that were not accessible before. However, it is still not quite enough for many reasons. First of all, the structures are still only nanometer-scale objects. It will be great if we can get them to micrometer or even millimeter sizes. Second, we need to increase the stability of structures for many applications. Third, we want to be able to transfer the structural information to a lot of other materials (e.g. metals, carbon, silicon, protein?) to achieve more functions."

Q: Any more insight into the mechanism that leads to self-assembly?

A: "Right now we don't have any new hypotheses. A more important task for now is to search a reliable assay for studying the assembly mechanism."

Q: Is there any way to put an estimated time frame on applications for DNA structure assembly, or describe the potential applications?

A:?"It is hard to predict a timetable. However, we believe we are really close to making high-profile real-world applications using DNA structures, considering the rapid growth of the field in recent years. Many papers have been published in the last couple of years, showing the potential for DNA structures in biophysical study, plasmonic devices, biosensoring, targeted delivery vehicle, etc.

Q: In May, we mentioned the potential for drug delivery or medical monitoring (for example, by nanomachines in the bloodstream). How does going from 2-D to 3-D change the outlook for applications? What are the big obstacles yet to be overcome?

A:?"For some applications, 2-D DNA structures would suffice. However, for applications like drug delivery, going 3-D makes all the difference. A delivery vehicle/machine has to be a 3-D object that contains protective shell, recognition sites, etc. Note that we are at early stage of developing nano medical devices using DNA structures. The biggest obstacles in the near future are perhaps how to increase the stability of DNA structures in complex biological environments and how to observe the behaviors of the DNA structures in vivo."?

Q: Anything to report on patenting these technologies or forming a venture to commercialize them?

A: "We have filed a provisional patent on the DNA-brick technique. We also have filed patents for other DNA techniques that we have invented in the past. We certainly expect that commercialization of these techniques will be a possibility in the future."

Starbucks to donate to RED for World AIDS Day

NEW YORK (AP) ? Starbucks Corp. is donating a portion of its proceeds on World AIDS Day to help fight the disease.

The company announced Thursday it would give five cents to the Global Fund of the RED foundation for each hand-crafted drink it sells on Saturday in the United States and Canada. The coffee shop is also partnering with iTunes, offering a digital $30 gift card that is divided into two $15 certificates to iTunes and Starbucks. Five percent of the proceeds to those gift cards, sold online, will also be donated to RED.

RED was founded by Bono and Bobby Shriver and links with brands to help raise money to fight AIDS. It benefits the Global Fund, which uses the money for HIV/AIDS programs in Africa.

(AP) ? Former International Monetary Fund chief Dominique Strauss-Kahn and a hotel maid who accused him of trying to rape her have reached an agreement to settle her lawsuit, likely ending a legal saga that forced the onetime French presidential contender's resignation and opened a floodgate of accusations against him, a person familiar with the case said Thursday.

Details of the deal, which comes after prosecutors dropped related criminal charges last year, weren't immediately known and likely will be veiled by a confidentiality agreement. That could prevent the two from speaking publicly about a May 2011 encounter that she called a brutally sudden attack and he termed a consensual "moral failing."

Lawyers for Strauss-Kahn and the housekeeper, Nafissatou Diallo, made the as-yet-unsigned agreement within recent days, with Bronx Supreme Court Justice Douglas McKeon facilitating that and a separate agreement to end another lawsuit Diallo filed against the New York Post, said the person, who spoke to The Associated Press on the condition of anonymity to discuss the private agreement. A court date is expected next week, though the day wasn't set, the person said.

Strauss-Kahn lawyer William W. Taylor III declined to comment. Lawyers for the housekeeper didn't immediately respond to phone and email messages.

Diallo, 33, and Strauss-Kahn, 63, crossed paths when she arrived to clean his luxury Manhattan hotel suite. She told police he chased her down, tried to yank down her pantyhose and forced her to perform oral sex.

The allegation seemed to let loose a spiral of accusations about the sexual conduct of Strauss-Kahn, a married diplomat and economist who had long been dubbed the "great seducer." He now faces charges linking him to a suspected prostitution ring in his home country.

With DNA evidence showing a sexual encounter and Diallo providing a gripping description of an attack, the Manhattan district attorney's office initially said it had a strong and compelling case. But within six weeks, prosecutors' confidence began to ebb as they said Diallo had lied about her past ? including a false account of a previous rape ? and her actions after leaving Strauss-Kahn's room.

Diallo, who's from Guinea, said she told the truth about their encounter. But the district attorney's office dropped the charges in August 2011, saying prosecutors could no longer ask a jury to believe her.

Diallo had sued Strauss-Kahn in the meantime, with her lawyers saying she would get her day in a different court. Strauss-Kahn called the lawsuit defamatory and countersued her for $1 million.

Her lawsuit against the Post concerned a series of articles that called her a prostitute and said she sold sex at a hotel where the Manhattan DA's office had housed her during the criminal case. The News Corp. newspaper has said it stands by its reporting; a spokeswoman declined to comment Thursday.

In helping resolve the cases, McKeon averted what could have been an ugly court drama.

Strauss-Kahn initially said he had diplomatic immunity, an argument the judge turned down in May. Strauss-Kahn's lawyers had since asked McKeon to throw out part of her claim for other legal reasons. Court records show the judge had yet to rule on that and several other legal issues, and it appeared that a high-stakes step ? depositions, or pretrial questioning under oath ? had not yet been taken. Depositions can give both sides information and a better picture of how strong the key parties and other witnesses might be in court.

While the vast majority of civil cases end in settlements, some legal observers were surprised that the deal between Strauss-Kahn and Diallo came before the legal arguments were resolved.

"I really expected it to go a little farther," said Matthew Galluzzo, a criminal defense lawyer and civil litigator who has been following the Strauss-Kahn case closely.

Still, the case likely had taken a toll on both Diallo, a single mother of a teenage daughter, and Strauss-Kahn, who has found himself plagued by accusations of sexual misconduct that further tarnished his reputation. The Socialist had been seen as a potential leading candidate for the French presidency before his New York arrest.

In France, judges are to decide by Dec. 19 whether to annul charges linking him to a suspected prostitution ring run out of a luxury hotel in Lille. He acknowledges attending "libertine" gatherings but denies knowing that some women present were paid.

In August, a separate case against Strauss-Kahn, centered on allegations of rape in a Washington, D.C., hotel, was dropped after French prosecutors said the accuser, an escort, changed her account to say she wasn't raped.

Soon after Strauss-Kahn's arrest in New York last year, French writer Tristane Banon accused him of attempting to rape her during an interview in 2003, a claim he called imaginary and slanderous. Prosecutors said they believed the encounter qualified as a sexual assault, but the legal timeframe to pursue her complaint had elapsed.

Strauss-Kahn has separated from his wife, journalist and heiress Anne Sinclair, who stood by him through the allegations in New York. The two said they were filing a lawsuit this summer against a French magazine, citing invasion of privacy, for reporting they had split, but Sinclair later acknowledged it was true.

The New York Times first reported the agreement between Strauss-Kahn and Diallo.

In the past two editions of the Politeia Forum we have analyzed the evolutions of the concept of Corporate Social Responsibility (CSR) and of the role of multinational corporations (MCNs). The Ninth Politeia Forum on? Corporations and Global Justice: Should Multinational Corporations be Agents of Justice? will seek to contribute to the international debate on the grounds and scope of the duties of MNCs. Global justice demands traditionally concern the duties of states and of their citizens; however, today there is a debate on whether such demands concern MCNs too. While it is widely recognised that the latter have the negative duty not to engage in harmful activities, it is less clear whether, and to what extent, they have the positive duty to remedy global injustices, by translating the respect of the UN Global Compact principles into an action aimed at fulfilling the Millennium Development Goals. Development will depend on the degree of cooperation between governments, international organizations, civil society, and business.

Aim of this edition is to frame the role of MCNs in the quest for global justice. At present, international CSR standards constitute a global ?institutional infrastructure? designed to help MNCs put into practice principles of global justice in their worldwide operations; however, a critical analysis of such standards is needed in order to assess the benefits and limits of their adoption. Moreover, the very concept of CSR appears to be insufficient to address the issues of global justice, as it generates only little impact on the structural root causes of injustice.

An alternative perspective based on justice could account better for the increasingly prominent political dimension of corporate responsibility: in this alternative view, responsibility is? shared among all relevant actors according to their different power, influence and capabilities. However, the 2011 UN Guiding Principles on Business and Human Rights seem to require a weak commitment to corporations, as they provide for the fulfillment of just the most? basic expectations of society in MCNs? respect. In fact, international human rights law require more than just avoiding the infringement of human rights, as it compels both states and the private sector to actively contribute to the fulfillment of socioeconomic rights. Thus, a better consideration of MNCs? positive obligations is needed, in order to alleviate poverty and inequality on a global scale. As a consequence, when linking global justice to corporate responsibility, it seems all the more necessary to better specify the fundamental? purpose of MCNs and in general of for profit corporations. One of the Forum?s main aims will be to show how a perspective based on global justice entails a new reflection on the purpose of for-profit corporations.

The Forum is organized by the Research Centre Politeia in partnership with the University of Milano ? Department of Social and Political Sciences, the? Dublin City University? ? Institute of Ethics, and the Global Compact Network Italy, and is supported by a Promoting Committee of several well-known Italian companies and organizations. Aim of Politeia is to organize a Forum in which managers of national and international companies and experts in business ethics and CSR from the most prestigious national and international research centres will have the opportunity to discuss the emerging ethical issues in the global economic system.? This way, it aims at increasing the awareness and knowledge of the ethical and social responsibilities of economic organizations, and at filling the gap between ?practitioners? and ?experts?.

An additional 8,924,123 players won smaller prizes, according to Powerball's website.

"There were 58 winners of $1 million and there were eight winners of $2 million. So a total of $74 million," said Chuck Strutt, Director of the Multi-State Lottery Association.

Hopeful players bought tickets at the rate of 131,000 every minute up until an hour before the deadline of 11 p.m. ET, according to lottery officials.

The jackpot had already rolled over 16 consecutive times without a winner. That fact, plus the doubling in price of a Powerball ticket, accounted for the unprecedented richness of the pot.

"Back in January, we moved Powerball from being a $1 game to $2," said Mary Neubauer, a spokeswoman at the game's headquarters in Iowa. "We thought at the time that this would mean bigger and faster-growing jackpots."

That proved true. The total, she said, began taking "huge jumps -- another $100 million since Saturday." It then jumped another $50 million.

The biggest Powerball pot on record until now -- $365 million -- was won in 2006 by eight Lincoln, Neb., co-workers. As the latest pot swelled, lottery officials said they began getting phone calls from all around the world.

"When it gets this big," said Neubauer, "we get inquiries from Canada and Europe from people wanting to know if they can buy a ticket. They ask if they can FedEx us the money."

The answer she has to give them, she said, is: "Sorry, no. You have to buy a ticket in a member state from a licensed retail location."

About 80 percent of players don't choose their own Powerball number, opting instead for a computer-generated one. Asked if there's anything a player can do to improve his or her odds of winning, Neubauer said there isn't -- apart from buying a ticket, of course.

Lottery officials put the odds of winning the $579 Powerball pot at one in 175 million, meaning you'd have been 25 times more likely to win an Academy Award.

Skip Garibaldi, a professor of mathematics at Emory University in Atlanta, provided additional perspective: You are three times more likely to die from a falling coconut, he said; seven times more likely to die from fireworks, "and way more likely to die from flesh-eating bacteria" (115 fatalities a year) than you are to win the Powerball lottery.

Segueing, then, from death to life, Garibaldi noted that even the best physicians, equipped with the most up-to-date equipment, can't predict the timing of a child's birth with much accuracy.

"But let's suppose," he said, "that your doctor managed to predict the day, the hour, the minute and the second your baby would be born."

The doctor's uncanny prediction would be "at least 100 times" more likely than your winning.

Even though he knows the odds all too well, Garibaldi said he usually plays the lottery.

When it gets this big, I'll buy a couple of tickets," he said. "It's kind of exciting. You get this feeling of anticipation. You get to think about the fantasy."

So, did he buy two tickets this time?

"I couldn't," he told ABC News. "I'm in California" -- one of eight states that doesn't offer Powerball.

Gov. Sam Brownback today kicked off a statewide weight-loss challenge aimed at instilling healthy habits, but he criticized new federal school lunch standards that provide healthier meals.

Brownback wants Kansans to organize into five-person teams to see which team can lose the largest percentage of weight.

Brownback intends to pick four members of his Cabinet to his squad.

"My hope is that the Governor's Weight Loss Challenge will encourage everyone to work together to make our state healthier," Brownback said at a news conference.

Kansas Department of Health and Environment Secretary Robert Moser, a physician, and also the State Health Officer, said the obesity rate has doubled among Kansas adults from 15 percent to 30.1 percent between 1995 and 2010.

"Together, poor nutrition and physical inactivity is now considered the No. 2 preventable cause of death, behind tobacco use," Moser said.

Obesity is associated with congestive heart failure, diabetes and cancer, he said.

The governor's challenge will award monetary prizes ? the amounts have not yet been determined ? to teams comprised of state employees. Brownback also urged non-state employees to take up the challenge.

A web-based tool will be used to track the progress of each state employee team that joins the competition. Teams can start registering on Dec. 17 at www.weightloss.ks.gov.

On the issue of school lunches, Brownback said the goal of the lunch standards was "laudable," but added, "It's a typical federal issue. It just doesn't fit all circumstances."

He said he has heard complaints from people that their children participate in school athletics and aren't getting enough calories with the lunches.

The standards, championed by First Lady Michelle Obama, are designed to "raise a healthier generation of children," according to the United States Department of Agriculture.

According to the USDA, the changes that took effect this school year ensure students are offered both fruits and vegetables each school day; increase whole grain foods; offer only fat-free or low-fat milk; limit calories based on the age of children being served; and increase focus on reducing saturated fats, trans fats and sodium.

It is being reported that a 23 year old woman, Mallory Owens was brutally beaten by her girlfriend?s brother because he didn?t approve of his sister?s relationship.

The beating came after Alex Hawkins brought her lover, Mallory Owens to a family Thanksgiving dinner which led to her 18 year old brother Travis Hawkins Jr taking intense displeasure at the fact that she was involved in a lesbian relationship. It is said after the dinner, Travis Hawkins knocked Mallory Owens to the floor before proceeding to savagely pummel her face with his fists.

Said Kristi Taylor, Mallory Owen?s mother: ?He tried to kill her. He?s lucky he didn?t kill her. She?s lucky to be alive. I didn?t recognize her when I got here. It?s hard to look at her like that.?

Pursuant to the beating the young woman was hospitalized and treated for a broken nose and numerous lacerations as well multiple skull fractures. Her eyes were swollen shut after the brutal beating and she had to receive facial reconstruction surgery.

According to Kristi Taylor there had been ongoing friction between her daughter and that of the Hawkins family who dissented over their daughter?s relationship with Mallory Owens.

Media outlet WKRG-TV reports that earlier this year, Hawkins allegedly hit Miss Owens over the head with a pipe wrench. While injured during that attack, no charges at the time were filed.

Upon hearing that her daughter would be joining the Hawkins family for thanksgiving dinner, Kristi Taylor urged her daughter otherwise: ?I did not want her to go, I begged her not to go, knowing how the family felt about her. But she said, ?They?re trying to be nice.??

Since the brutal beating a Facebook group entitled ?Charge Travis Hawkins Jr with the attempted murder of Mallory Owens? has sprung up on Facebook, garnering nearly 600 likes in less than a day.

But it gets worse, according to Miss Owens? sister Avery Godwin, she?told AL.com that Travis Hawkins later called her on Friday to say ?that he would finish what he started last night with Mallory.?

The outlet goes on to report that Travis Hawkins Sr was later released on bail and the case was never brought to trial after his son refused to testify against him.

Since the attack, Travis Hawkins Jr has been arrested by authorities and charged with second degree assault and consequently later released the same day after making bond. Then again that may tell us something about the general attitude towards same sex couples in certain quarters of the country and the implicit state condoning of such behavior and attitudes which to some degree embolden intolerance towards same sex couples.

One also wonders about the general degree of dysfunction in the family and the malicious behavior of male role models in the Hawkins family, which may suggest a lot why Alex Hawkins chose to be a lesbian in the first place?
