Free Legal Question: Wills and Trusts | Florida | I am a resident of ...

I am a resident of Florida. My wife and I are in the process of compiling a living will using forms from an online site. We plan on naming our eldest daughter as the executor. With regards to our home, does she automatically get the home on providing the living will and death certificates, or do we need to include a quit-claim deed in with the living will? (This is assuming my wife and I die together)

(AP) ? Nearly two years after his brother Gordon was killed in the Deepwater Horizon oil rig explosion, Chris Jones had planned to drive in from Baton Rouge with other relatives to attend the start of the federal trial over the nation's worst offshore oil disaster.

But Jones learned Sunday that a judge had delayed the start of the trial from Monday to March 5 because oil giant BP PLC was making progress in settlement talks with a committee overseeing scores of lawsuits. Jones said he has mixed feelings about the prospect of a settlement, adding that he would be disappointed if BP manages to "write a check to solve their problems."

"I was ready to go to trial and see their feet held close to the fire," he said Sunday. "It seems like the easy way out to pay whatever the plaintiffs are willing to take."

Two people close to the case told The Associated Press the decision to postpone was made Sunday during a conference call between parties in the Gulf of Mexico oil spill case and U.S. District Judge Carl Barbier. They spoke on condition of anonymity because they were not authorized to discuss the call.

They said the judge told those on the call that BP and the Plaintiffs' Steering Committee were "making some progress" in their settlement talks. The steering committee is overseeing lawsuits filed by individuals and businesses following the explosion on the Deepwater Horizon rig on April 20, 2010. The blast killed Gordon Jones and 10 other workers and led to 206 million gallons of oil spewing from the blown-out well, soiling miles of coastline.

However, the judge did not mention the status of settlement talks between other parties, nor did he mention any figures being discussed, according to the people close to the case.

The brief order issued by Barbier on Sunday said only that the delay was granted "for reasons of judicial efficiency and to allow the parties to make further progress in their settlement discussions."

Among other things, the trial that is now set to begin March 5 is meant to determine the penalties that need to be paid by BP and other companies involved in the oil spill. Billions of dollars are at stake.

BP and the Plaintiffs Steering Committee confirmed in a joint news release that the trial had been delayed. It said the oil giant and the PSC were working to reach an agreement that would "fairly compensate people and businesses affected by the Deepwater Horizon accident and oil spill."

"There can be no assurance that these discussions will lead to a settlement agreement," the joint statement said.

Separately, BP has had discussions in recent days with the federal government and cement contractor Halliburton Energy Services Inc., according to several people close to the case.

If no settlement is reached, Barbier will preside over a three-phase trial that could last the better part of a year. The first phase is designed to identify the causes of the deadly blowout and to assign percentages of fault to the companies involved in the ill-fated drilling project.

Financial analysts estimate BP could wind up paying anywhere from $15 billion to $30 billion over the lawsuits, and BP has estimated in regulatory filings that its total liability for the disaster is $40 billion.

An AP analysis found that the company could conceivably face up to $52 billion in environmental fines and compensation if the judge determines the company was grossly negligent.

The trial may not yield major revelations about the causes of the disaster, but the outcome could bring much-needed relief for tens of thousands of people and businesses whose livelihoods were disrupted by the spill.

Relatives of the 11 people killed in the Deepwater Horizon blast say they are hoping for something more elusive: justice for lost loved ones.

Sheryl Revette, whose husband, Dewey, was also among the 11 killed when BP PLC's Macondo well blew out and triggered an explosion on the drilling rig, doesn't have anything to gain financially from the trial. She wants an apology from the oil giant, something she said she hasn't received yet.

"I've never heard a word from them," said Revette, 48, of State Line, Miss. "But an apology isn't going to bring my husband back."

The decisions and actions that led to the explosion and spill already have been painstakingly investigated by the Coast Guard, federal regulators and a presidential commission. Their probes concluded that BP, rig owner Transocean Ltd. and Halliburton deserve to share the blame for a string of risky decisions that were designed to save time and money.

Transocean spokesman Lou Colasuonno wouldn't comment Sunday on whether the company, which owned the Deepwater Horizon rig, was participating in settlement talks.

"This deal does not change the facts of the case and Transocean is fully prepared to go to trial," he said of BP's settlement talks with the plaintiffs.

The massive scope of the case ? a maze of claims and counterclaims between the companies, federal and state governments and plaintiffs' attorneys ? has elicited comparisons to the tobacco litigation of the 1990s.

Roughly 340 plaintiffs' lawyers have worked on the oil spill case. BP has spent millions of dollars on experts and law firms. More than 300 depositions have been taken. Millions of pages of legal briefs have been filed. One Justice Department lawyer said it would take him 210 years to read all the pages submitted into the record if he read 1,000 pages a day.

Barbier, a former president of the Louisiana Trial Lawyers Association and appointee of President Bill Clinton, has a reputation for speedy but fair trials. He will hear and decide the case without a jury. Each trial phase is expected to last two to three months, with breaks in between. Even if all parties settle their claims before or during the trial, it could take several months for claims to be paid.

Chris Jones, an attorney, said he's not surprised that BP would seek to avoid a long, costly trial.

"I know that is part of the game, so to speak," he said. "As long as they're paying a lot of money for the damage they caused, it would give me some relief."

Oil rises to fresh 9-month high near $109 in Asia

Benchmark crude for April delivery was up 75 cents to $108.58 per barrel midday Singapore time in electronic trading on the New York Mercantile Exchange. The contract rose $1.55 to settle at $107.83 in New York on Thursday.

Brent crude was up 50 cents at $124.22 per barrel in London.

The government said Thursday that the number of people seeking unemployment benefits last week was unchanged and that the four-week average was the lowest in four years.

Traders brushed off evidence that crude demand in the U.S. remains weak. The Energy Department's Energy Information Administration said Thursday crude inventories rose 1.6 million barrels last week and that oil demand has dropped 6.7 percent from a year ago.

"The ability of crude to post new highs in the face of what appeared to be a bearish EIA report attests to the underlying strength of this price advance," energy trader and consultant Ritterbusch and Associates said in a report. "The oil market has evolved into somewhat of a self perpetuating cycle in which new highs beget new buying that forces new highs."

Crude has jumped from $96 earlier this month amid growing tension over Iran's nuclear program and fears global crude supplies could be disrupted. Some analysts expect economic sanctions by the U.S. and Europe and countermeasures by Iran will help keep crude prices elevated this year.

"There is a relatively high and growing probability to a scenario in which there is no resolution in 2012, in which oil prices grind higher along with a gradual escalation of tension," Barclays Capital said in a report.

In other energy trading, heating oil rose 0.1 cent to $3.29 per gallon and gasoline futures added 0.8 cent to $3.30 per gallon. Natural gas fell 3.2 cents to $2.59 per 1,000 cubic feet.

Like, this state-level bill proposed by Republican Jerry Bergevin of New Hampshire that would mandate the teaching of the Bible in public schools:

?The Holy Bible is the bedrock of Western civilization. Love it or hate it, it?s in every aspect of humanity,? said sponsor Rep. Jerry Bergevin of Manchester.

Bergevin?s bill would require all schools to offer an elective social studies course in Bible studies, where students would examine the Old Testament, the New Testament or both, and learn ?biblical content, characters, poetry and narratives that are the prerequisites to understanding contemporary society and culture, including literature, art, music, morals, oratory and public poetry.?

Currently, the only state prescription for social studies electives is that students must take a half-credit of world history, geography or global studies to graduate.

Because forcing schools to teach the Bible would give them the opportunity to steep the children in the Western civilization that is so foreign to them or something. Never mind that they are immersed in said civilization every day, have a very high likelihood of being raised to believe in the Bible in their home lives, and it is beyond cruel to force non-Christians to study the Bible in the same way as it is cruel to teach reality like evolution to these kids. While they fight for ?academic freedom? on one front, they fight to take it away on another. The unmitigated gall.

An Alabama Republican senator thinks that raising teacher salaries is against the Bible, despite hefty raises he voted for senators:

?It?s a Biblical principle. If you double a teacher?s pay scale, you?ll attract people who aren?t called to teach,? said McGill.

Thailand: Iranians planned terror attack on Israelis

Thailand's police chief said the Iranians who were arrested after accidentally setting off explosives at their rented home in Bangkok were plotting to attack Israeli diplomats, bolstering claims by Israel that the group was part of an Iranian-backed network of terror.

"I can tell you that the target was specific and aimed at Israeli diplomatic staff," police chief Gen. Prewpan Dhamapong told a Thai television station late Wednesday.

He also confirmed that the type of explosive ? a homemade "sticky" bomb ? found at the blast site Tuesday matched the devices planted on Israeli diplomatic cars in India and Georgia a day earlier.

"The type of improvised explosives they used were the same. The type that was attached to vehicles," Prewpan said, confirming that an investigation into a magnetic strip found in Bangkok was the same type used in New Delhi.

The comments were the first confirmation by Thailand that the explosions this week were part of a terror plot to be carried out in the country. It raises concerns that even Thailand ? a sunny tourist destination long perceived to be off the global terror map ? is equally vulnerable to attacks.

A red flag was raised last month, with the arrest of a Lebanese-Swedish man with alleged links to Hezbollah who led police to a warehouse near Bangkok packed with more than 8,800 pounds (4,000 kilograms) of urea fertilizer and other materials that could be used to make bombs.

Israel and the United States at the time warned their citizens to be alert in Bangkok.

The U.S. Embassy said that foreign terrorists may have been looking to attack tourist areas in Bangkok and Thai media reported the attacks were aimed at Israeli targets, including the Israeli Embassy. Thai authorities insisted that Thailand was a staging ground for attacks but not the target.

Thai officials say it is not clear if the two incidents are connected.

Authorities in Thailand are still trying to determine if the Iranian men were part of a larger terror group. Two of the men were detained in Bangkok on Tuesday after fleeing the destroyed house, while a third was arrested Wednesday in neighboring Malaysia after boarding a flight from Bangkok to Kuala Lumpur overnight.

Israel accuses Iran of waging a campaign of state terror and has threatened military strikes on Iranian nuclear facilities, while Iran has denied responsibility for all three plots this week.

On Monday in New Delhi, an explosion tore through an Israeli diplomatic vehicle, wounding the driver and a diplomat's wife. On the same day in the former Soviet republic of Georgia, authorities say attackers planted an explosive device on the car of a driver for the Israeli Embassy, but it was discovered and defused before going off.

Israeli Prime Minister Benjamin Netanyahu denounced the violence.

"If this aggression isn't halted, ultimately it will spread to many other countries," Netanyahu said in Israel's parliament Wednesday. He convened his Security Cabinet to discuss terrorism against Israel and "Iran's involvement in repeated attempts to attack Israeli targets," his office said.

Israeli Ambassador to Thailand Itzhak Shoham told The Associated Press in an interview Tuesday that the similarity of the bombs found in Bangkok and New Delhi has led Israel to believe the groups are linked.

"We can assume that there is the same network of terror," he said.

Iran's Foreign Ministry spokesman Ramin Mehmanparast called the allegations baseless and said Israel was trying to damage his country's relations with Thailand and fuel conspiracy theories. Iran has blamed the Jewish state for the recent killings of Iranian atomic scientists.

Thai police have named the Iranians in custody here as Saeid Moradi, who lost at least one leg in a self-inflicted grenade blast as he tried to flee police, and Mohammad Kharzei, who was detained Tuesday as he tried to board a flight to Malaysia.

Each man faces four criminal charges: possession of explosives, attempted murder, attempted murder of a policeman and causing explosions that damaged property.

Thai officials identified the third suspect as Masoud Sedaghatzadeh, and officials in Malaysia said he was arrested there Wednesday.

Malaysia federal police spokesman Ramli Yoosuf said Sadaghatzadeh was being investigated for terrorism-related activities linked to the Bangkok blasts, but could not say whether he would be extradited to Thailand.

At least five bombs were identified in Bangkok. The first blew off the roof of the men's house, and Moradi detonated two others. He hurled one at a taxi when its driver refused to give him a ride, and threw the other at police to fend them off. The taxi driver and three other Thais were wounded in the taxi blast.

When police searched the men's house in the busy Sukhumvit Road area, a bomb squad found and defused two explosives, each made of three or four pounds of C-4 explosives inside a pair of radios.

The type of explosives suggested they would have been used to target individuals rather than large crowds or buildings, said National Security Council chief Wichean Potephosree.

The top remaining suspect in the 2002 Bali nightclub bombings went on trial today, more than a decade after the attacks brought international attention to Jemaah Islamiyah, a previously overlooked Al Qaeda-linked group operating in Southeast Asia.

Umar Patek, believed to be a member of the group, is accused of building the bombs used in the attacks, which killed 202 people. He was captured in January 2011, in Abbottabad, Pakistan ? the same town where Osama bin Laden was hiding when he was captured and killed by the US ? and extradited from Pakistan in August. He began trial today in Jakarta.?

With Mr. Patek's capture and the trial and execution of the three "masterminds" of the 2002 Bali bombings, authorities say they've made substantial progress?dismantling?Jemaah Islamiyah, the Associated Press reports. At the time of Patek's arrest, he was one of the region's most wanted terrorists and carried a $1 million bounty.

Patek is also accused of a series of Christmas Eve bombings at churches in 2000, according to AP.

Reuters describes the Bali nightclub bombings as a "watershed" for Indonesia, forcing the secular state, which is also home to the world's largest Muslim population, to "confront the presence of violent militants on its soil." Almost 600 militants were detained after the bombings and most of them have been convicted. The militant threat was greatly diminished as a result, aided by the lack of popular support for violent militants.

Patek faces charges of premeditated murder, bombmaking, and illegal firearms possession, among others, but no terrorism charges because the country's terrorism law came into effect in 2003 and cannot be applied retroactively, according to BBC. Prosecutors said they will push for the death penalty, but Patek may be sentenced to life imprisonment instead.

The 1,540-pound bomb built by Patek ? known as "demolition man" for his expertise with bombs ? was hidden inside filing cabinets and loaded into a van, which was then detonated outside the two nightclubs, mostly killing foreign tourists. Patek told interrogators he built the bomb using basic household items, such as a rice ladle, a grocer's scale, and plastic bags, the Associated Press reports.

While homemade bombs are commonly used by militants all over, ones as powerful as the one made by Patek ? out of household items ? indicates an "enormous amount of care and expertise," according to AP. Patek told interrogators he learned to make bombs while at a militant academy in Pakistan from 1991-94 and later in Afghanistan. He was living in Indonesia when one of the plotters of the nightclub bombings asked him about making a bomb for the attacks.

He left Bali a few days before the attacks happened, heading to the Philippines, where he joined local extremist group Abu Sayyaf and trained militants and plotted attacks.?Patek was in Pakistan, en route to Afghanistan, when he was caught. He hoped to fight alongside the Taliban or another militant group and had refused an offer to teach at a militant camp in Indonesia, AP reports.?
